If your organization is deploying artificial intelligence — or even just thinking about it — the legal ground beneath you is shifting faster than most compliance programs can keep up.

Across industries, from financial services and healthcare to retail and manufacturing, AI is no longer a future-state consideration. It is embedded in hiring platforms, customer service chatbots, fraud detection engines, medical diagnostic tools, and supply chain management systems. And with that rapid deployment has come an equally rapid — if uneven — regulatory response. For legal and compliance professionals, the challenge is no longer simply understanding AI. It is understanding how AI governance, privacy law, and organizational resilience interlock to form a single, integrated risk surface that demands a coordinated strategy.

This post explores that convergence and offers a framework for thinking about it practically.

AI and the Law: A Regulatory Landscape Taking Shape

For years, AI operated in something of a regulatory vacuum. Organizations developed and deployed machine learning models, automated decision-making systems, and generative AI tools with relatively little sector-specific legal guidance. That era is decisively over.

The European Union's Artificial Intelligence Act, which entered into force in 2024 with phased compliance obligations extending into 2026 and beyond, represents the most comprehensive attempt by any jurisdiction to regulate AI on a risk-based spectrum. The Act classifies AI systems into categories — from minimal risk to unacceptable risk — and imposes escalating obligations on providers and deployers of higher-risk systems. High-risk AI systems, such as those used in employment decisions, credit scoring, law enforcement, and critical infrastructure, must satisfy requirements related to data governance, transparency, human oversight, accuracy, and robustness. Violations carry substantial penalties, with fines reaching up to 35 million euros or seven percent of global annual turnover, whichever is greater.

In the United States, the regulatory picture is more fragmented but no less consequential. There is no single federal AI statute analogous to the EU AI Act, but a patchwork of activity is coalescing. The Biden Administration's 2023 Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence set a broad policy direction emphasizing safety, civil rights, privacy, and innovation. While subsequent administrations may recalibrate federal priorities, the executive order catalyzed agency-level action that continues to reverberate. The Federal Trade Commission has signaled — and in several enforcement actions demonstrated — that it views deceptive or unfair AI practices as squarely within its authority under Section 5 of the FTC Act. The Equal Employment Opportunity Commission has issued guidance on how Title VII and the Americans with Disabilities Act apply to AI-driven hiring tools. The Consumer Financial Protection Bureau has reminded financial institutions that automated decision-making does not exempt them from adverse action notice requirements under the Equal Credit Opportunity Act and the Fair Credit Reporting Act.

At the state level, activity has been vigorous. Colorado enacted legislation addressing high-risk AI systems with obligations around impact assessments, disclosure, and risk management. Other states, including Illinois, Texas, and California, have pursued or enacted measures targeting specific AI applications such as biometric data collection, deepfakes, and automated employment decisions. For organizations operating nationally, this multiplicity of state-level requirements creates compliance complexity that rivals — and in some ways exceeds — the challenges posed by the state privacy law landscape.

Sector-specific regulators are also stepping in. In financial services, federal banking regulators and the SEC have focused on model risk management, algorithmic trading, and AI-driven advisory services. In healthcare, the FDA has developed a framework for regulating AI and machine learning-based software as a medical device. The net effect is that virtually every organization deploying AI at scale must now navigate a multilayered regulatory environment that spans jurisdictions, sectors, and risk categories.

Privacy at the Center: Where AI Meets Data Protection

If AI governance is the emerging frontier, privacy law is its most established neighbor — and the two share an increasingly contested border. Nearly every AI system of consequence is built on data, and much of that data is personal. This makes privacy law not just relevant to AI but foundational to it.

The General Data Protection Regulation remains the most influential privacy framework globally, and its principles bear directly on AI development and deployment. The GDPR's data minimization principle requires that personal data be adequate, relevant, and limited to what is necessary for the purposes for which it is processed. This principle sits in tension with the data-hungry nature of many machine learning models, which often perform better with larger and more diverse training datasets. Organizations must grapple with how to build effective AI systems while respecting the principle that more data is not always lawfully better.

Equally significant is the GDPR's regulation of automated decision-making. Article 22 provides that individuals have the right not to be subject to decisions based solely on automated processing that produce legal effects or similarly significant effects, unless certain conditions are met. Where automated decision-making is permitted, data subjects are entitled to meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing. This so-called "right to explanation" poses real challenges for organizations deploying complex AI models — particularly deep learning systems — where the internal logic may be opaque even to the engineers who built them. Explainability is not merely a technical preference; it is, in many contexts, a legal requirement.

In the United States, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, has introduced rights and obligations that intersect with AI in important ways. The CPRA established the California Privacy Protection Agency and expanded consumer rights around automated decision-making technology, including the right to opt out of such processing and the right to access information about the logic behind it. The CPPA has been actively developing regulations on automated decision-making that, once finalized, could impose significant transparency and opt-out requirements on businesses using AI to make decisions about consumers. Other comprehensive state privacy laws — in Virginia, Connecticut, Colorado, Texas, Montana, Oregon, and elsewhere — similarly include provisions addressing profiling and automated decision-making, though with varying levels of specificity and enforcement.

Beyond individual rights, privacy law also shapes the upstream lifecycle of AI development. Questions about lawful bases for processing training data, the use of publicly available information, cross-border data transfers for model training, and the application of purpose limitation principles to AI systems that may be repurposed across use cases all demand careful legal analysis. For privacy counsel, AI is not a discrete compliance workstream — it is a dimension of virtually every existing privacy obligation.

Consent, long a cornerstone of privacy frameworks, becomes particularly fraught in the AI context. Meaningful consent requires that individuals understand what they are consenting to. When personal data is used to train a model that may be deployed across a range of unpredictable future applications, the specificity and informed nature of any initial consent may be called into question. Privacy professionals must evaluate whether consent remains a viable lawful basis for many AI processing activities or whether other bases — such as legitimate interest, contractual necessity, or statutory authorization — provide a more durable foundation.

Resilience as a Legal Imperative

Organizational resilience — the capacity to anticipate, withstand, recover from, and adapt to adverse conditions — has always been a business priority. What is relatively new is the degree to which resilience has become an explicit legal and regulatory expectation, particularly for organizations that rely on AI-driven systems.

The EU's Digital Operational Resilience Act, known as DORA, which became applicable in January 2025, exemplifies this trend. DORA imposes detailed requirements on financial entities and their critical ICT third-party service providers to ensure operational resilience, including robust ICT risk management frameworks, incident reporting obligations, resilience testing, and third-party risk management. While DORA is sector-specific to financial services, its influence extends well beyond that sector, as regulators in other industries and jurisdictions look to it as a model for operational resilience regulation.

Cyber resilience has also become a regulatory priority. The EU's NIS2 Directive broadened the scope of cybersecurity obligations across essential and important entities in sectors ranging from energy and transport to digital infrastructure and public administration. In the United States, the SEC's cybersecurity disclosure rules for public companies, which took effect in late 2023, require timely disclosure of material cybersecurity incidents and periodic disclosure of cybersecurity risk management, strategy, and governance. The message from regulators is consistent: organizations must not only prevent cyber incidents but must also demonstrate that they can detect, respond to, and recover from them effectively.

AI adds a distinctive dimension to the resilience conversation. AI systems can introduce novel failure modes — model drift, adversarial manipulation, data poisoning, hallucination in generative AI systems — that traditional business continuity and disaster recovery frameworks were not designed to address. An AI-driven credit underwriting model that begins producing biased outcomes due to distributional shift in input data is not a conventional IT outage; it is a subtle, potentially high-impact failure that requires continuous monitoring, human oversight mechanisms, and rapid remediation capabilities. Resilience in the AI context means building governance structures that can detect and respond to these AI-specific risks in real time.

Incident response planning must also evolve. When an AI system fails or produces harmful outcomes, organizations face a cascade of legal obligations: breach notification under privacy laws, incident reporting under cybersecurity regulations, adverse action notices under consumer protection and fair lending statutes, and potential disclosure obligations under securities laws. A well-designed AI incident response plan must map these overlapping obligations and ensure that the organization can meet them concurrently and under time pressure.

Third-party risk adds yet another layer. Many organizations do not build their AI systems in-house but rely on vendors, cloud providers, and open-source models. Resilience requires that organizations understand their AI supply chain, assess the resilience of their AI vendors, and contractually allocate responsibilities for monitoring, incident response, and continuity. The regulatory trend — visible in DORA, NIS2, and emerging U.S. guidance — is toward holding organizations accountable not only for their own resilience but for the resilience of their critical third-party providers.

Bringing It All Together: Toward an Integrated Strategy

The most significant risk facing many organizations today is not that they will fail to comply with any single AI, privacy, or resilience regulation. It is that they will approach these domains in silos — building an AI ethics framework here, a privacy compliance program there, and a cyber resilience plan somewhere else — without recognizing that these are facets of a single, interconnected risk landscape.

An integrated approach begins with governance. Organizations should establish cross-functional governance structures — whether through an AI governance committee, a risk council, or an expanded privacy and compliance function — that bring together legal, compliance, information security, data science, and business leadership. These structures should have clear mandates, sufficient authority, and access to the technical expertise needed to evaluate AI systems holistically.

Risk assessment is the next critical building block. Privacy impact assessments, AI impact assessments, and operational resilience assessments should not be conducted in isolation. An AI system that processes personal data at scale implicates privacy, fairness, transparency, and resilience considerations simultaneously. Organizations that conduct integrated assessments — evaluating an AI system's data practices, decision-making logic, potential for bias, failure modes, and incident response readiness in a single coordinated process — will be better positioned to identify and mitigate compounding risks.

Documentation and accountability matter enormously. The EU AI Act's requirements for technical documentation and conformity assessments, the GDPR's accountability principle and records of processing activities, and DORA's requirements for ICT risk management documentation all point in the same direction: regulators expect organizations to be able to demonstrate — not merely assert — that they have identified, assessed, and mitigated the risks associated with their AI systems. Building a culture of documentation from the earliest stages of AI development is both a legal necessity and a practical advantage.

Transparency and communication with stakeholders must also be part of the strategy. Employees, consumers, regulators, and business partners all have legitimate interests in understanding how an organization uses AI, how it protects personal data, and how it ensures operational continuity. Proactive transparency — through clear privacy notices, accessible AI use disclosures, and well-rehearsed incident communication plans — builds trust and reduces the reputational damage that can accompany AI-related failures.

Finally, organizations must invest in ongoing monitoring and adaptation. AI systems are not static; they evolve as they are retrained, as input data changes, and as they are deployed in new contexts. The regulatory landscape is similarly dynamic, with new laws, guidance, and enforcement actions emerging regularly. Compliance programs that are built once and left alone will quickly become obsolete. Continuous monitoring — of AI system performance, of regulatory developments, and of emerging risks — is essential.

Looking Ahead: Practical Takeaways for Legal and Compliance Professionals

The convergence of AI governance, privacy law, and resilience regulation is not a temporary phenomenon. It reflects a durable structural shift in how governments and societies think about technology risk. For legal and compliance professionals navigating this landscape, several practical principles are worth keeping in mind.

First, break down internal silos. The organizations that will manage AI-related legal risk most effectively are those that foster genuine collaboration among privacy, cybersecurity, AI governance, and business teams. If your AI governance program does not speak to your privacy program, and neither speaks to your incident response plan, you have gaps that regulators and adversaries alike will find.

Second, prioritize risk-based approaches. Not every AI system carries the same level of legal risk. Focus your most intensive governance, assessment, and monitoring efforts on the AI systems that pose the greatest risks to individuals and to the organization — those that make consequential decisions about people, process sensitive personal data, or operate in critical infrastructure.

Third, invest in explainability and transparency now. The regulatory direction is unmistakably toward greater explainability of automated decisions and greater transparency about AI use. Organizations that build explainability into their AI systems from the design stage — rather than retrofitting it under regulatory pressure — will have a significant compliance advantage.

Fourth, treat resilience as a governance function, not just an IT function. Operational resilience in the AI context requires executive-level attention, board-level oversight, and integration into enterprise risk management. It cannot be delegated solely to technical teams.

Fifth, stay engaged with the regulatory landscape. The law in this area is evolving rapidly, and what is best practice today may become a legal requirement tomorrow. Active engagement with regulatory developments — through industry groups, public comment processes, and ongoing legal monitoring — is essential for staying ahead of the curve.

The organizations that thrive in this environment will be those that view AI governance, privacy compliance, and resilience planning not as separate obligations but as complementary components of a single, strategic commitment to responsible innovation. The legal and compliance function is uniquely positioned to lead that effort — and the time to start is now.
